Terms of Service

These terms are the agreement between you and Clicktag for using the free, cookie-free web analytics service at clicktag.io and clicktag.app. By creating an account or adding the Clicktag script to a site, you agree to them.

Who we are

In these terms, "Clicktag", "we" and "us" mean the team behind Clicktag. You can reach us at legal@clicktag.io.

"You" means the person who creates a Clicktag account, or the company they sign up for. If you sign up for a company, you confirm you're allowed to accept these terms on its behalf.

The service

Clicktag measures traffic on websites you own or manage. You add our script to your pages or send data through our API, and Clicktag turns it into reports in your dashboard at clicktag.app: pageviews, visitors, referrers, campaigns, events, goals, funnels, retention, Live view, email reports, API monitoring, and optional imports from Google Search Console and Cloudflare.

Clicktag is free to use. If we ever add paid plans or paid features, we'll announce the price at least 30 days before it applies to you, and we'll never charge you unless you choose a paid plan yourself.

Your account

  • You sign in with a Google account. Keep it secure: you're responsible for what happens under your account.
  • You must be at least 16 years old.
  • Use an email address you actually read; we send service messages there.
  • When you share a site with someone, they can see all of its reports, including Live view, Search Console and API data. They need their own Clicktag account.
  • If you make a dashboard public, anyone with the link can see its main reports. Keep a site private if its numbers are confidential.

Your data

The data collected for your sites is yours. You give us permission to store and process it only to run Clicktag for you: collecting it, building your reports, sending the emails you set up and keeping the service secure.

We don't sell it, we don't use it for advertising, and we never show one customer's site data to another, except through the sharing and public dashboards you turn on yourself.

What we collect and how long we keep it is described in our Privacy Policy.

Data processing

When your sites send visitor data to Clicktag, you decide what is collected and why, and we process it for you. Where that data is personal data under the GDPR, you are the controller, we are your processor, and this section is our data processing agreement (Article 28 GDPR):

  • We process visitor data only to provide Clicktag as described in these terms and the settings you choose. If we think an instruction breaks the law, we'll tell you.
  • Everyone at Clicktag with access to it is bound to confidentiality.
  • We protect it with the security measures in our Privacy Policy, including encryption in transit and a visitor hash that changes every day.
  • We use the subprocessors listed in the Privacy Policy. We'll announce new ones at least 30 days before we start using them; if you object, you can stop using Clicktag.
  • We help you answer visitors who use their privacy rights, and help with security questions and impact assessments, as far as we reasonably can.
  • If we learn of a personal data breach affecting your data, we tell you without undue delay.
  • When you close your account or ask us to delete a site, we delete its data within 30 days, unless the law requires us to keep it.
  • We give you the information you need to check that we keep these promises, and answer reasonable audit questions in writing.

Your responsibilities

You decide what to measure, so you're responsible for:

  • adding Clicktag only to sites and apps you own or are allowed to measure;
  • telling your visitors that you use Clicktag where the law requires it, for example in your own privacy policy;
  • keeping personal data out of page paths, query parameters, event names and event metadata (no names, email addresses, phone numbers or customer IDs that point to a person);
  • having a legal basis for any data you choose to send us.

Acceptable use

Don't use Clicktag to:

  • send fake, automated or inflated traffic, or measure sites you don't control;
  • try to reach other customers' data, probe or attack our systems, or get around limits;
  • flood or load-test our servers without asking us first;
  • break the law, including tracking people in ways the law doesn't allow.

We don't cap pageviews, but we may slow down, block or remove traffic, sites or accounts that break these rules or put the service or other customers at risk. Where we can, we'll tell you first and give you a chance to fix it.

Other services

Signing in uses Google. If you connect Google Search Console or Cloudflare, Clicktag gets read-only access that you can remove at any time. Your use of those services stays under their own terms.

Availability

We aim to keep Clicktag fast and online, but we provide it "as is" and "as available", without guaranteed uptime. Some visits are never counted: browsers with Do Not Track switched on are not recorded, ad blockers can stop the script, and we filter out bots.

We may add, change or remove features. If we remove something you rely on, we'll tell you in advance where we reasonably can.

Ending your use

You can stop using Clicktag at any time: remove the script from your sites and email us to close your account. We delete your account and your sites' data within 30 days.

We may close your account if you seriously or repeatedly break these terms. If we ever stop offering Clicktag, we'll give you at least 30 days' notice.

Liability

Nothing in these terms limits liability that the law doesn't allow us to limit, such as liability for intent or gross negligence.

Apart from that, we're not liable for indirect or consequential loss, such as lost profits, lost revenue or lost data, and our total liability for anything related to Clicktag is limited to the amount you paid us in the 12 months before the claim, or EUR 100 if that's higher.

You're liable for claims from others caused by data you send to Clicktag or by using Clicktag in breach of these terms.

Changes to these terms

We may update these terms. For changes that matter, we'll email account owners at least 30 days before they take effect. If you keep using Clicktag after that, the new terms apply; if you don't agree, you can stop using Clicktag and close your account. The date at the top shows the current version.

Law and disputes

Dutch law applies to these terms. Disputes go to the competent court in the Netherlands. If you use Clicktag as a consumer, you keep the protection of the mandatory consumer law of the country you live in, and you can also go to court there.
